Abstract

The explicit evidence that forbids women from taking over the presidency is the statement of the Prophet (peace and blessings of Allaah be upon him): "Some people will not succeed and they will have a woman." However, those who allowed women to be heads of state from modern times have responded to this hadeeth as a lie to the Messenger of Allaah (peace and blessings of Allaah be upon him). Some of them said that the Sunnah is not the constitutional law argument at all, and some of them said that it is not an argument in that law. Some of the scholars claimed that the scholars differed concerning the validity of this hadeeth, and some of them attributed it to him because of the uniqueness of the narration of his narration. To complete what the researchers started before me, and proved that this hadeeth is an argument and is valid for the evidence Do it.

الملخص

إن أصرح نص ورد بمنع تولية المرأة رئاسة الدولة في الإسلام حديثُ أبي بكرة رضي الله عنه عن النبي صلى الله عليه وسلم أنه قال: "لن يفلح قوم وَلَّوْا أمرهم امرأة". ولكن المجيزين لتلك التولية من المعاصرين ذهبوا في الجواب عن هذا الحديث كل مذهب، حتى إن منهم من أغرب فزعم أنه مكذوب موضوع، ومنهم من نفى حجية السنة في القضايا الدستورية مطلقا، ومنهم نفى في تلك القضايا حجية حديث الآحاد فقط، ومنهم من زعم في هذا الحديث أنه مختلف في صحته، ومنهم من طعن عليه بتفرد راويه به؛ كلُّ ذلك لتسقط حجيته رأسا من أول الأمر؛ بحيث يُغني سقوطُ حجيَّـتِه عن طويل المباحثة في دلالته، وكثير المناقشة في أوجه التصرف فيها؛ وهو في الواقع ما لم أجد من العلماء– في حد بحثي- من تصدى لمناقشته إما مطلقا، وإما مناقشةً شافية وافية تامة؛ وبخاصة ما تعلق من تلك الطعون بدعوى الاختلاف في صحة هذا الحديث، ودعوى مخالفته للواقع مخالفة تقتضي الحكم عليه بالوضع؛ فرأيت لذلك أن أسد هذا الخلل بتكميل ما ابتدأه الباحثون قبلي، وتميم ما شرعوا من ذلك فيه، لعلي أقوم لحجية هذا الحديث بما يثبتها ويقيمها، على وفق المنهج العلمي المحايد، والمسلك البحثي المنصف، غيرَ مُتَعرِّضٍ لدلالته في محل الحكم، إلا بقدرِ ما يتوقف عليه الجواب عن نفي حجيته.
