Abstract

The study aimed to define the concept of the divorce of the drunk which means the termination of marriage contract by the utterance of divorce produced by the drunken husband. The study presented the different faqihs’ opinions, displayed their proofs, discussed them, and concluded with the predominant opinion that the divorce does not take place in reality if the husband was drunk. The study compared that conclusion with the new Jordan Personal Status Law number (36) for year 2010 which claims that the drunk’s utterance of divorce does not terminate marriage contract. The study included an introduction, three parts and a conclusion

تتلخص الدراسة في بيان مفهوم طلاق السكران الذي يعني رفع قيد نكاح الزوجين بلفظ الطلاق الصادر من الزوج حال سُكره، ثم بيان آراء الفقهاء المختلفة في حكمه على قولين، وعرض الأدلة ومناقشتها والترجيح بعدم وقوع طلاق السكران حال كونه سكرانا، حقيقة وواقعاً، مع مقارنتها بقانون الأحوال الشخصية الأردني الجديد رقم (36) لسنة 2010م الذي أخذ بعدم وقوع طلاقه، وجاء البحث في مقدمة وثلاثة مباحث وخاتمة
