Abstract

The legislator normally forms the conflict rules, or what is called the backing rules, to constrain the compulsory application of the rules when disagreement takes place on legal relations containing foreign elements. Some of these relations refer to marriage and whatever related to it, and the properties whether materiality or moral like the legal rights of writers, trade and industry. It is noticed that the financial conflict rules discussed in Jordan Civil Law is not sufficient to handle emerged problem concern these subjects. It is also found that it needs a new comprehension to be modernized. A deep look into studying what is important and what is essential, we found that what concerns disagreements on marriage and properties in this law is the most essential part of in our study.

الملخص

يضع المشرع عادة قواعد تنازع القوانين، أو كما تسمى قواعد الإسناد، لتحديد القانون الواجب التطبيق، عند حصول نزاع في علاقة قانونية تتضمن عنصراً أجنبياً. ومن هذه العلاقات الزواج وما يتعلق به، والأموال المادية وغير المادية (الحقوق المعنوية)، كحق المؤلف والحقوق المعنوية الصناعية والتجارية. والملاحظ بأن قواعد التنازع الحالية محل البحث في القانون المدني الأردني، لم تعد كافية لمعالجة ما يستجد من مشاكل معاصرة بشأن هذه المواضيع، ولذلك فهي بحاجة إلى قراءة جديدة لتحديثها من خلال سد النقص فيها أو تعديلها. وإذا كانت غالبية قواعد التنازع الواردة في الباب التمهيدي للقانون المدني الأردني بحاجة إلى هذا التحديث، فإن الباحث ومن باب الرغبة في التعمق البحثي وتقديم الأهم على المهم، وجد بأن ما يتعلق بالزواج والأموال من قواعد التنازع يعد الأكثر إلحاحاً ولذلك كرس لهما هذا الجهد.
