Abstract

This paper deals with family violence against women that has become a social phenomenon about which several conferences, workshops and campaigns have been held. The paper investigates the causes of violence, its patterns, its prevalence and danger. As an introduction to the related Islamic legislation, established to limit the phenomenon and its effects, a literature review is included. In addition, Islamic legislative measures proposed in numerous Islamic sources (Fiqh, Tafseer and Hadeeth) were studied and analyzed. As a result, this research concluded that family violence in our society is prevalent and badly needs necessary measures to encounter this phenomenon in order to reduce it. This study came up with ten Islamic measures that may contribute to limit the phenomenon.

الملخص

يعالج هذا البحث العنف العائلي الواقع على المرأة، والذي انتشر هذه الأيام لدى معظم شعوب الأرض حتى اعتبر ظاهرة اجتماعية تعقد لمعالجتها المؤتمرات والورشات والحملات في كل مكان. فهو يبحث في أسباب العنف، ويعرض لأنماطه ولمدى انتشاره، وللتوصيات التي تضمنتها الأدبيات السابقة بخصوصه، مقدمة لاستعراض التشريعات الإسلامية الوقائية والعلاجية التي تسعى للحد من درجة انتشاره. الأدبيات الحديثة ذات العلاقة، كانت منطلقا للتعريف بمفهوم العنف وبدرجة انتشاره وبالعوامل التي تغذيه، وبالتوصيات والتدابير العامة للحد منه. أما التدابير الشرعية، فقد جرى تقصيها والبحث فيها من خلال المصادر الاسلامية المعتمدة في التفسير والحديث والفقه. خلص البحث إلى التسليم بانتشار العنف العائلي في مجتمعاتنا بشكل يستدعي وضع التدابير اللازمة لمعالجته، كما توصل الى عشرة تدابير شرعية تسهم في الحد من الظاهرة.
