Abstract

This paper dwelt on two issues: Proof through checking up in fiqh and law and proof through expertise in fiqh and law. Checking up is considered one means of proof which the judge or his deputy may use. Proof through expertise is also a means of evidence. However, an expert assigned by the court can provide the evidence or proof. The researcher concluded that the issues, in which we depend on experts ‘statements to prove them, are many and developed. The expert or the assessor’s report, for conflict resolution, is an evidence in the lawsuit. However, it is not binding to the judge.

الملخص

هذا البحث يحمل عنوان: الإثبات بالمعاينة والخبرة في الفقه والقانون. وقد اشتمل على مبحثين رئيسين مع مقدمة وخاتمة، تكلمت في المبحث الأول عن: الإثبات بالمعاينة في الفقه والقانون، وان المعاينة تعتبر وسيلة من وسائل الإثبات ويقوم بها القاضي أو من ينيبه. وفي المبحث الثاني تكلمت عن: الإثبات بالخبرة في الفقه والقانون وأن الخبرة من وسائل الإثبات المعتبرة الا أن الذي يتولى أمرها الخبير المختص والمكلف من قبل المحكمة. وخلصنا الى ان القضايا التي يمكن الاعتماد فيها على قول أهل الخبرة كثيرة ومتطورة وأن التقرير المقدم من قبل الخبير او المعاين لمحل النزاع يعتبر دليلا في الدعوى. الا انه غير ملزم للقاضي.
