الملخص

يتناول البحث موضوع التحريض على القتل الذي موجبه القصاص، وقد هدف الباحث إلى بيان معنى التحريض، وحكمه، ووسائل التحريض من خلال تتبع آراء الفقهاء، واستقراءها من مظانها، وقد خلص البحث إلى أن وسائل التحريض ليست نوعا واحدا؛وإنما أنواع عدة، أما عن عقوبة المحرِّض فقد جنح الباحث إلى رأي الجمهور القاضي بوجوب القصاص على المحرض نظراً لكون المكرِه والمكرَه مشتركان في القتل، والاشتراك في القتل يوجب القصاص على الشريكين، فالمكرِه المتسبب توفر فيه قصد القتل، والمكرَه المباشر توفر فيه مباشرة القتل.
