Penal law is dominated by an important principle, it s the principle of legality "no crime, no penalty, without text". For a long time the "Text" meant the Law, work of legislative authority (Parliament). But today, we find the executive authority plays a big role in legislating about crimes and punishments, next to legislative authority by Reglements. It s about devising the power of legislating about crimes and penalties between Law and Reglementations.
