This paper tackles the harm resulting from the unemployed doctor’s mistake in hospitals. The unemployed doctor is the one who is not officially employed in the hospital but is often recalled to operate on some patients. We should identify the meaning of the medical responsibility and its legal regulations regarding the medical mistakes committed by the unemployed doctors. This should be done in accordance with the theory that holds the ordinates responsible for their subordinates’ actions. Moreover, it is known that the surgeon often needs assistance during operations, the hospital is often held responsible for the assistants, medical mistakes because hospitals should make every measure the safety of patients. The law holds the ordinates responsible for their subordinates’ practices regarding any illegal harmful actions in order to protect the harmed.

يتحدث البحث عن الضرر الناتج عن الخطأ الذي يتسبب به الطبيب غير الموظف الذي لا يرتبط بوظيفة رسمية مع المستشفى، وإنما يقوم بعمل داخل المستشفى من شأنه معالجة المرضى الذين يحتاجونه لإجراء عمليات لهم. ولا بد من الوقوف على معنى المسؤولية الطبية ونظامها القانوني عن الأخطاء الذي يتسبب بها الأطباء غير الموظفين في ضوء نظرية مسؤولية المتبوع عن أفعال التابع، وبحث هذه المسؤولية فيما إذا كانت مسؤولية عقدية أم مسؤولية تقصيرية، وكذلك من المعروف أن الطبيب يحتاج إلى مساعدين أثناء إجراء العمليات داخل المستشفى، فيتحدد في نطاق المسؤولية الطبية الضرر الذي يتسبب به هؤلاء، لأن المعروف أن من يُسند إليه عمل لا بد من ترتيب أموره بما يؤدي حسن تصرفه وعدم إلحاق الضرر. وقد حدد القانون مسؤولية المتبوع عن أفعال التابع، نتيجة الأعمال الضارة وغير المباحة والتي ألحقت الضرر عن الأفعال التي قاموا بها، وهذه المسؤولية ما هي إلا نوع من الضمانة التي أوجدها المشرع حماية للمتضرر.
