This study deals with the participation of the average individual in the preliminary investigation procedures, and the extent of the contribution of this role in the achievement of criminal justice, Where we find that the Palestinian criminal legislator authorized individuals to contribute to carrying out some preliminary investigation procedures, This contribution appears through his participation with the primary investigation authorities in carrying out some procedures in cases of flagrante delicto, such as giving their statements about the incident, not leaving the scene of the crime, physical exposure, assisting judicial officers in arresting the accused, and conducting preventive inspections, This contribution also appears in the judicial inspection procedure, such as empowering and assisting the judicial police officers in conducting the inspection, and when the legislator authorized individuals to play this role, he intended from behind that their contribution to the achievement of criminal justice.

تتناول هذه الدراسة مشاركة الفرد العادي في إجراءات التحقيق الابتدائي، وما مدى مساهمة هذا الدور في تحقيق العدالة الجنائية، حيث نجد أن المشرع الجنائي الفلسطيني أجاز للأفراد المساهمة في القيام ببعض إجراءات التحقيق الابتدائي، وتظهر هذه المساهمة من خلال مشاركته لسلطات التحقيق الابتدائي في القيام بعض الإجراءات في أحوال التلبس بالجريمة، كقيامهم بالإدلاء بأقوالهم بشأن الواقعة، وعدم مغادرة مكان وقوع الجريمة، والتعرض المادي، ومساعدة مأموري الضبط القضائي في القبض على المتهم، وإجراء التفتيش الوقائي، كما تظهر هذه المساهمة في إجراء التفتيش القضائي، كتمكين ومساعدة مأموري الضبط القضائي في إجراء التفتيش، وعندما خوّل المشرع الأفراد القيام بهذا الدور كان يبتغي من وراء ذلك مساهمتهم في تحقيق العدالة الجنائية.
