Abstract

Talking in this search for personal rights stipulated in the Jordanian Constitution as these rights and received the preamble to the Constitution and the means to that of the great importance that Thoudy these rights as they affect the personal life of individuals and they responded in the materials of 6-10 and Article 18 was these texts, protective. Mshamlh this rights and this is not enough to be followed by a text of the legislation and regulations that conform this legislation with constitutional provisions and when opposes any legislation or regulation with constitutional text is this legislation or regulating is invalid because the Constitution is the law foundation should not be violating the top of the pyramid, we find that some of the legislation violates the constitutional text and will discuss this issue and develop solutions. The personal power Thoudy the utmost importance to the level of the world as a whole and this makes it the focus of attention and care by the state and became a measure of democracy to any country in the world measured in their application to human rights and to the selection of personal rights which I will treat all of these topics in this research. I hope to be taking the proposals and address the discrepancy by legislation and regulations to Aldstoriaobges texts how powerful these texts in the event of a conflict of any statute or law to her.

الملخص

ان هذا البحث يستعرض الحقوق الشخصية المنصوص عليها في الدستور الأردني، ومدى الالتزام بها حيث أن هذه الحقوق وردت في مقدمة الدستور، ويعني ذلك الأهمية الكبيرة التي تحظى بها هذه الحقوق لأنها تمس الحياة الشخصية للأفراد، واقتصرت هذه الحقوق على المواد من(6و7 و8و9و10 و18) من الدستور الاردني وكانت هذه النصوص واضحة وشاملة لهذه الحقوق، وهذا لا يكفي يجب أن يتبع ذلك النص عليها في التشريعات والأنظمة، وأن تتوافق هذه التشريعات مع النصوص الدستورية، وعند تعارض أي تشريع أونظام مع نص دستوري يعتبر هذا التشريع أوالنظام باطل لأن الدستور هوالقانون الأساس والقانون الأسمى في الدوله ويجب أن لا يتم مخالفته، وهورأس الهرم إلا أننا نجد أن بعض التشريعات تخالف نص دستوري وسيتم بحث هذا الموضوع ووضع الحلول المناسبه. إن الحقوق الشخصية تحضى في أهمية بالغة على مستوى دول العالم قاطبة، وهذا يجعلها محط اهتمام ورعاية من قبل الدولة، وأصبح مقياس الديمقراطية لأي دولة في العالم يقاس في مدى تطبيقها إلى حقوق الإنسان، وعلى التحديد الحقوق الشخصية منها وإنني سوف أعالج جميع هذه المواضيع في هذا البحث. وآمل أن يتم الأخذ بالمقترحات ومعالجة التعارض من قبل التشريعات والأنظمة  للنصوص الدستورية ان وجدت، وبحث مدى الألتزام في هذه النصوص في حال تعارض أي تشريع أوقانون معها.
