Abstract

The principle of permanence by writing the exception to the rule must be written evidence to prove civil legal actions in excess of one hundred Jordanian dinars in Jordanian law, and two hundred JD or equivalent in the local currency in the Palestinian law and then evidence may testify in the contractual obligations even if it is to be worth more than the amount mentioned if any principle of proof in writing. his study aims to highlight the principle of permanence writing from where the concept statement, and features, and his staff, and the impact of its availability, and then study reviewed the position of the judiciary Jordanian and Egyptian to apply, has emerged a number of study results and recommendations have been installed in the finale.

الملخص

يعدّ مبدأ الثبوت بالكتابة استثناءً على قاعدة وجوب الدليل الكتابي في إثبات التصرفات القانونية المدنية التي تزيد قيمتها على مائة دينار أردني في القانون الأردني، ومائتي دينار أردني أو ما يعادلها بالعملة المتداولة قانوناً في القانون الفلسطيني، ومن ثمّ يجوز الإثبات بالشهادة في الالتزامات التعاقدية حتى لو كان المطلوب تزيد قيمته على المبلغ المذكور إذا وجد مبدأ ثبوت بالكتابة. تهدف هذه الدراسة إلى تسليط الضوء على مبدأ الثبوت بالكتابة من حيث بيان مفهومه، وميزاته، وأركانه، والأثر المترتب على توافره، ومن ثم استعرضت الدراسة موقف القضاء الأردني والمصري من تطبيقه، وقد خرجت الدراسة بعدد من النتائج والتوصيات تم تثبيتها في الخاتمة.
