Abstract

Man complains of Uproar in modern times. That is, the uproar and high sound noise that affects human life passively. The study aims at dealing with the subject jurisprudentially. The researcher followed inductive approach and analytical approach to show jurists’ opinions represented in the sharia provisions concerning uproar, and to clarify the negative effects of uproar upon man in particular. The study has concluded that the person causing uproar harming to the others is considered to be sinful. Another result is that Islam put forward legislations and rules that guarantee environments free from uproar to preserve psychological and physical safety and made balance between human rights for work and making a living and his right with settled life full of calmness and tranquility, by preventing jobs producing uproar inside residential areas or beside them if it causes harm for neighboring dwellers.

الملخص

يشكو الإنسان في العصر الحديث من الضوضاء، ويراد بها الضجيج والأصوات العالية التي تؤثر في حياة الإنسان تأثيرًا سلبيًا. وتهدف هذه الدراسة إلى معالجة موضوع الضوضاء فقهيًا، وبيان الآراء الفقهية المختلفة حول هذا الموضوع. واستخدمت الباحثة المنهج الاستقرائي والمنهج التحليلي في عرض آراء الفقهاء المتمثلة في بيان الأحكام الشرعية المتعلقة بالضوضاء، وبيان آثارها السلبية على الإنسان بشكل خاص، مما يؤثر على المجتمع بشكل عام، ويحد من نموه اقتصاديًا واجتماعيًا. وقد توصلت الدراسة إلى أن الشخص الذي يمارس سلوكًا ينتج عنه ضوضاء تؤذي الآخرين يُعدّ آثمًا شرعًا، وأن الدين الإسلامي وضع التشريعات والقوانين التي تضمن للإنسان بيئة خالية من الضوضاء، للمحافظة على سلامته الجسدية والنفسية، ووازن بين حق الإنسان في العمل واكتساب العيش، وبين حقه في حياة مستقرة تضمن له الهدوء والسكينة بمنع الأعمال التي تصدر عنها ضوضاء داخل المساكن أو بجوارها إذا أدت إلى الإضرار بالمجاورين.
