Abstract

The present research tackles a debatable jurisprudence issue related to the way of moving the finger while saying al-tashshahud in prayer (certifying that there is no God but Allah and that Mohammad is a prophet of Allah). This issue is dealt with in Hadith and jurisprudence to stress the importance of using both Hadith and jurisprudence to decrease disagreement .This paper gathered the relevant narratives، analyzed them، revealed their problems and areas of disapproval. Finally، the scholars' views were clarified and the most acceptable view was clarified which says that the fundamental issue is to move the finger once rather than moving it continuously.

الملخص

يتناول البحث مسألة فقهية كثر الخلاف حولها ألا وهي "هيئة تحريك الإصبع في التشهد في الصلاة"، وذلك بدراستها حديثياً وفقهياً، ليبين البحث بدوره أهمية اللقاء الحديثي الفقهي في الحد من الخلافات الفقهية؛ وقد تناول البحث هذه المسألة جامعاً للمرويات المتعلقة بها، كاشفاً صحيحها ومعلولها، مبيناً مواطن الشذوذ والنكارة في شقه الحديثي. وتمم الجانبي الفقهي بنائه بتناول آراء الفقهاء، وصولاً إلى الرأي الراجح مستفيداً من الكشف الحديثي السابق؛ فجاء البحث بجملته يبين أن الأصل في حركة الأصبع الإشارة لا الموالاة في التحريك.
