Abstract

This research seeks to explain the definition of abortion، why it is considered a crime، in addition to clarifying its elements and conditions as well as the consequent judicial punishments. Abortion is a deliberate، unjustified termination of a pregnancy before the natural time of birth. Abortion is prohibited in Islam because it violates the laws and orders of Allah and a gains the right of the fetus to live، a threat to the mother’s life and an offense on community as a whole. The Islamic Criminal Legislation lays down just punishments on those who commit this crime including Al-Gurrah (Blood Money)، Atonement (Kaffarah)، and deprivation of inheritance…etc whenever the crime’s conditions and elements are available. This research aims to raise the awareness of the Muslims and to warn them against committing this crime. There should also be official legislations and preventive measures implemented to ensure that this crime will be eliminated from the Islamic community.

الملخص

يسعى هذا البحث إلى توضيح مفهوم جناية الإجهاض وعلة تجريمها، وشرح أركانها وشروطها، وبيان ما يترتب عليها من عقوبات قضائية. فالإجهاض هو إنهاء – متعمد وبلا ضرورة – لحالة الحمل، قبل الموعد الطبيعي للولادة، وهو جناية يحرمها الإسلام لما فيها من انتهاك لحرمات الله تعالى، واعتداء على مصلحة الجنين والأم والمجتمع الإنساني. كما يوقع النظام الجنائي الإسلامي عقوبات عادلة على مقترف هذه الجناية، من غُرّة وكفّارة وتعزير وحرمان من الميراث، وغيرها، عند توفر أركانها وتحقق شروطها. وإن هذا البحث يهدف إلى توعية المسلمين وتحذيرهم من اقتراف هذه الجناية، وضرورة اتخاذ تشريعات رسمية وتدابير احترازية، لمنع وقوعها، واستئصالها نهائياً.
