Abstract
This study discusses the issue of the rule of the seizer of power from an Islamic perspective. It introduces evidence given by those who consider it legitimate and others who find it illegitimate and unacceptable in Islam. The issue is tackled with reference to Islam scriptures and the main principles of Islam. The researcher concludes that the rule of a seizer of power contradicts with Islamic legislations and principles.

الملخص
تناولت هذه الدراسة مسألة ولاية المتغلب، ذكرت فيها أدلة من قال بشرعيتها، وأدلة من ذهب إلى عدم شرعيتها، وناقشت هذه المسألة من خلال النصوص الشرعية ومقاصد الشريعة ومبادئها، وخلصت إلى أن التغلب يتنافى مع أحكام الشريعة وقيمها، وأن من وصل إلى كرسي الحكم بالإكراه، فإن ولايته غير شرعية.
