Abstract

This study aims to reveal the major Islamic principles that govern the state of war in Islam compared to international law while highlighting the practical aspect of these principles. For this purpose, the study was based primarily on the analytical descriptive approach to trace and analyze these principles in Qur'ānic texts, Prophetic Sunnah, and the deeds of the righteous caliphates. The study showed, from an Islamic perspective, war is run in accordance with rules that constitute an ethical framework, which keeps balance between war necessities and human considerations. Therefore, Islam has been concerned about ease of the consequences of using force through restricting the Islamic state to a group of principles including: respect of humanity, distinction between civilian and combatants, proportionality of using force and not to exceed military necessity

الملخص

تهدف هذه الدراسة إلى الكشف عن المبادئ الإسلامية الكبرى التي تحكم حالة الحرب في الإسلام مقارنة بالقانون الدولي مع إبراز الجانب التطبيقي لهذه المبادئ. وقد تمت هذه الدراسة بالاستناد بشكل رئيس إلى المنهج الوصفي التحليلي بهدف تتبع وتحليل هذه المبادئ في النصوص القرآنية، والسيرة النبوية، وأفعال الخلفاء الراشدين، وسيرة الصحابة بعد وفاة النبي . وخلصت الدراسة إلى أن الحرب في المنظور الإسلامي تسير وفقاً لقواعد تشكل بمجموعها إطاراً أخلاقياً يحفظ التوازن بين الضرورات الحربية والاعتبارات الإنسانية، إذ حرص الإسلام على التخفيف من آثار استخدام القوة عبر تقييد الدولة الإسلامية بمجموعة من المبادئ هي: احترام الإنسانية، والتمييز بين المقاتلة وغيرهم، والحرص على التناسب عند استعمال القوة. كما بينت الدراسة أن جميع الفئات الأساسية التي تم منحها الحماية عبر معاهدات جينيف، محمية أيضاً بموجب القانون الإسلامي، بل إن من القيود التي أرساها القانون الإسلامي على مقاتليه، ما يتجاوز متطلبات القانون الدولي الإنساني بمراحل.
