Abstract

This research deals with an important topic theoretically and practically, the topic is "The relationship between the Audit Bureau of Jordan and the Judiciary and the Executive Authority "a comparative study". The government exercises three legal functions: legislation( ), Execution( ) and Judiciary( ), the Judiciary Authority ensures that the laws are respected and the Executive Authority ensure that the law are implemented to punish the offender and that justice is carried out according to the will of the nation in accordance with the law. The Executive Authority applies the laws to those who are responsible and the judiciary shall hold accountable those who violate these rules the Audit Bureau reports play a vital role in controlling the activity of the government, as the relationship between the Audit Bureau and the Judiciary and the Executive Authority is strong, as we will be noted in this research. We discuss this research in two topics in the first opicwe studied the Audit Bureau relation with the Judiciary Authority, in the second topic we studied the Audit Bureau relation with the Executive Authority. Finally we have come through this study to a number of conclusions and recommendations, thus the noble reader will find in this research that we didn’t preserve any effort in order to achieve the aim of this research, Intending to all that the face of God Almighty.

الملخص

يتناول هذا البحث موضوعاً مهماً على الصعيد النظري والعملي وهو علاقة ديوان المحاسبة الأردني بالسلطتين القضائية والتنفيذية "دراسة مقارنة"، تمارس الدولة ثلاث وظائف قانونية وهي التشريع والتنفيذ والقضاء يكفل القضاء احترام القوانين بينما تسهر السلطة التنفيذية على تنفيذها ليعاقب المخالف ويقام العدل حسب إرادة الأمة وفقاً للقانون فالسلطة التنفيذية تطبق القوانين على المكلفين ويحاسب القضاء من يخالف تلك القواعد، وتلعب تقارير ديوان المحاسبة دوراً حيوياً في بسط رقابته على نشاط الحكومة إذ أن علاقة ديوان المحاسبة بالسلطتين القضائية والتنفيذية قوية على النحو الذي سنشير إليه في هذا البحث. حيث عالج الباحث هذا البحث في مبحثين في المبحث الأول علاقة ديوان المحاسبة بالسلطة القضائية، وفي المبحث الثاني علاقة ديوان المحاسبة بالسلطة التنفيذية، وأخيراً توصل الباحث من خلال البحث إلى عدد من النتائج والتوصيات، هذا وسيجد القارئ الكريم في هذا البحث إن الباحث لم يألُ جهداً في سبيل تحقيق الغاية التي قصدها، مبتغي بكل ذلك وجه الله سبحانه وتعالى.
