Abstract

Corruption crimes are severe offenses that damage trust between state institutions and citizens, impacting the state’s integrity and reputation. Given rapid technological and informational advancements, legislators must work to curb these crimes and equip judicial authorities with specialized investigative tools that respect individual privacy—such as electronic ambuscades. This approach balances the public interest in exposing crimes and penalizing offenders with the individual’s right to privacy and confidentiality. Ensuring this balance protects freedoms while enabling the Public Prosecution to pursue and punish criminals effectively. Statement of the Problem: This study examines the compatibility of electronic ambuscades with constitutional protections for personal freedom. Objective: The study assesses whether current legislative texts sufficiently regulate electronic ambuscades by clarifying who may perform them, under what conditions, for what duration, and whether judicial authorization is necessary. It also examines the impact of this practice on personal freedom. Methodology: A descriptive-analytical approach was used to analyze all legal aspects related to electronic ambuscades. Results: The study finds that legislators have sought to balance the state’s right to combat corruption with individuals constitutionally protected right to privacy. Recommendations: The study recommends establishing clear procedural and objective guidelines for electronic ambuscades. These include specific conditions and guarantees for their use, defined timeframes, renewal limits, and the requirement for judicial authorization.

الملخص

تعتبر جرائم الفساد من الجرائم الخطيرة والتي تزعزع جسور الثقة ما بين مؤسسات الدولة ومواطنيها، كما انها تضر بسمعة ونزاهة الدولة، ونظراً للتطور التكنولوجي والمعلوماتي الهائل في عصرنا الحديث استوجب على المشرع السعي إلى الحد من ارتكاب هذه الجرائم وتمكين الجهات القضائية من اللجوء إلى اساليب تحر ذات طابع خاص كونها تمس الحياة الخاصة للأشخاص، كالترصد الإلكتروني، وذلك من خلال خلق التوازن بين مصلحة المجتمع في الكشف عن الجرائم ومعاقبة مرتكبيها وبين ومصلحة الافراد في الحق في حياتهم الخاصة والحفاظ على مستوع السر لهم، فلا تنتهك الحرمات ولا تهدر الحريات ، وفي المقابل لا تغل يد النيابة العامة في ملاحقة المجرمين وانزال العقاب بحقهم. الإشكالية: تمثلت إشكالية البحث في مدى توافق الترصد الالكتروني مع الحرية الشخصية المحمية دستوريا. الهدف: تهدف هذه الدراسة الى تحديد مدى كفاية النص التشريعي من حيث شمولية النص لممارسة أسلوب الترصد الالكتروني، الجهة التي يحق لها ممارسته، شروط ممارسته ومدة اتخاذ الاجراء وان كان بحاجة الى اذن قضائي لممارسته وتحديد أثره على الحرية الشخصية. المنهج: اتبع الباحث المنهج الوصفي والتحليلي لتغطية جميع الجوانب القانونية في اجراء أسلوب الترصد الالكتروني. النتائج: خلص البحث الى مجموعة من النتائج من أهمها ما ذهب اليه المشرع في خلق التوازن بين حق الدولة في محاربة تفشي الفساد في أروقة مؤسساتها والتصدي له تحقيقاً للمصلحة العامة وبين الحق في الخصوصية المكفول دستوريا للأشخاص بصون مستودع الاسرار لديهم. التوصيات: اوصت هذه الدراسة بضرورة توفير جملة من الضمانات الموضوعية والاجرائية لممارسة الترصد الالكتروني وخصوصا تحديد شروطه وضماناته بشكل مفصل ودقيق وتحديد مدة ممارسة الاجراء ومدد تجديده وكذلك ضرورة الحصول على اذن قضائي.
