Abstract

This study examines the circulation of unlawful video recordings, considering it both as an independent crime and as actions that may constitute criminal participation in the offense of electronic blackmail. Objectives: The study aims to shed light on one of the modern and dangerous criminal activities that still lacks sufficient legal regulation, especially given the scarcity of research addressing this specific issue. The growing spread of this phenomenon calls for a serious reconsideration of the legislative framework governing it. The research seeks to determine the legal nature of acts involving the circulation of unlawful video recordings. Methodology: The researcher adopted an inductive-analytical approach to understand the legal nature of this criminal activity and to explore its dimensions, whether as an independent crime or as actions that constitute participation in the crime of electronic blackmail. Research Problem: The central problem of this study lies in the following main question: What is the legal nature of acts involving the circulation of unlawful video recordings? The researcher answers this question through a detailed analysis of the legal framework regulating such acts under the applicable legislation in Palestine. Findings: The study concluded that the perpetrators’ actions in circulating unlawful video recordings may constitute criminal participation in the crime of electronic blackmail as accomplices. Alternatively, such acts may amount to an independent crime if they represent a violation of privacy or constitute defamation or insult through electronic means. Recommendations: The study recommends tightening the penalties imposed on acts involving the circulation of unlawful video recordings.

خلفية البحث: تناولت هذه الدراسة تداول التسجيلات المرئية غير المشروعة باعتبارها جريمة مستقلة وبوصفها أيضًا أفعالًا تُشكل اشتراكًا جرميًا في جريمة الابتزاز الإلكتروني، الأهداف: تهدف الدراسة إلى تسليط الضوء على أحد الأنشطة الإجرامية الحديثة والخطيرة، التي ما زالت تفتقر إلى معالجة قانونية كافية، وخصوصًا في ظل ندرة الأبحاث التي تناولت هذا الموضوع تحديدًا، كما أن انتشار هذه الظاهرة يستوجب وقفة جادة لإعادة تقييم الإطار التشريعي الناظم لها، وقد هدفت الدراسة إلى تحديد الطبيعة القانونية لأفعال تداول التسجيلات المرئية غير المشروعة، المنهج: اعتمد الباحث المنهج الاستقرائي التحليلي لفهم الطبيعة القانونية لهذا النشاط الإجرامي، واستجلاء أبعاده في سياق كونه جريمة مستقلة أو بوصفه أفعالًا تُشكل اشتراك جرمي في جريمة الابتزاز الإلكتروني. إشكالية الدراسة: تتمثل إشكالية الدراسة في السؤال الرئيس الآتي: ما هي الطبيعة القانونية لأفعال تداول التسجيلات المرئية غير المشروعة؟ حيث سيجيب الباحث عن هذه السؤال من خلال دراسة مفصلة للإطار القانوني الناظم لأفعال تداول التسجيلات المرئية غير المشروعة في التشريعات السارية في فلسطين. النتائج: توصلت الدراسة أن أفعال الجناة في تداول التسجيلات المرئية غير المشروع قد تشكل اشتراكًا جرميًا في جريمة الابتزاز الالكتروني بوصفهم متدخلين، وقد تكون جريمة مستقلة إذا كانت تشكل انتهاك لحرمة الحياة الخاصة، أو جريمة ذم أو قدح من خلال الشبكة الالكترونية. التوصيات: توصلت الدراسة إلى توصيات أهمها ضرورة تشديد العقاب على أفعال التداول للتسجيلات المرئية غير المشروعة.
