Abstract
Objective: This study examines the theory of acts of sovereignty in Saudi administrative judiciary, focusing on its statutory basis, criteria for identification, scope of application, and implications for balancing state sovereignty, the principle of legality, and the protection of individuals’ rights.
Methodology: The study adopted the inductive and analytical approaches by examining relevant legal literature, Saudi statutory texts, and related judgments of the Board of Grievances. It also evaluated three main criteria for distinguishing acts of sovereignty from administrative acts: the political motive criterion, the nature-of-the-act criterion, and the judicial-list criterion.
Results: The study showed that the absence of a precise statutory definition of acts of sovereignty has given administrative courts a central role in determining the scope of this theory. It was also found that none of the three criteria is sufficient on its own to provide a precise distinction between acts of sovereignty and ordinary administrative acts. The judicial applications examined in the study revealed that some royal orders, acts related to foreign relations, and acts connected to state security and the integrity of the state have been classified within the scope of acts of sovereignty. In some applications, the judiciary tends to exclude both annulment and compensation claims when the dispute concerns an act of sovereignty, considering this exclusion a matter of jurisdictional competence that the court may raise on its own initiative.
Conclusions: The study supports retaining the theory of acts of sovereignty within a narrow scope limited to acts directly connected to the supreme sovereign functions of the state. It also argues that political considerations alone are insufficient to shield administrative acts from judicial review, and that excluding annulment claims should not necessarily preclude compensation for special and exceptional harm, provided that compensation is limited to redressing the harm without annulling the sovereign act or affecting its legal effects.Recommendations: The study recommends developing clearer criteria for identifying acts of sovereignty, strengthening the role of administrative courts in examining the nature of the disputed act, limiting exclusion from judicial review to the narrowest scope required by necessity, and encouraging further doctrinal and judicial comparative studies on this theory.
