Abstract
Although the arbitration formed a mechanism to exclude the regular judicature to rule into the disputes, and in spite of the undertaking by certain parties to judge into them, according to the willingness of the litigants, yet the judicial surveillance remains an assured necessity in this concern. This essentially required to safeguard the determination of the litigating parties, on one hand, and the state on the other. This is quite clear through the observation and control of the magistrate to whatever is going against the public policy order. Moreover, the Jordanian legislator kept in mind the role of the judicature in assisting the arbitrators for the aim of brining the arbitration process to success. In this concern, the judicature system is the sole party to appoint the official arbitrator and revision of the disqualification and discarding demands against the arbitrators, as well as the permission to implement the timely decisions of the arbitration panels, in addition to its powers to interpret the awards of the arbitrators. Even though, these tasks which are assumed to the judicature are sometimes unclear, and complicated in other instances. The views are different about the areas in which the magistrate might have a control over, and subsequently, the judge is obliged to determine the area and limits of his task through the accurate interpretation of the rules of the arbitration law. Within this framework, this study is made as an attempt to determine the scopes through which the judge may have powers to intervene in the arbitration process. The particularity of the arbitration issue which requires the application of both the domestic and foreign rules, in addition to the international conventions, may oblige the judge to deliberate more in depth in the judgments, especially because the development of the arbitration issue in Jordan is connected to solutions and situations provided by the judicature that may substantiate this legal institution.

الملخص
لئن شكلت مادة التحكيم آلية لاستبعاد القضاء الرسمي للفصل في النزاعات وتعهد أشخاص خاصة بالفصل فيها وفق إرادة الأطراف فان الرقابة القضائية تبقى ضرورة حتمية في هذا المجال وذلك حماية لإرادة الأطراف من جهة والدولة من جهة أخرى وهو ما يتبلور من خلال مراقبة القاضي لكل ما هو مخالف للنظام العام. ولم يغب عن المشرع الأردني دور القضاء في مساعدة المحكمين بهدف إنجاح عملية التحكيم فاختص الجهاز القضائي بتعيين المحكم الرسمي والنظر في مطالب القدح والتجريح في المحكمين، والإذن بتنفيذ القرارات الوقتية لهيئات التحكيم إضافة إلى ما له من سلطات لتفسير قرارات المحكمين على أن هذه الأعمال المستندة إلى القضاء قد اكتساها الغموض حينا والتعقيد أحيانا واختلفت الآراء حول المجالات التي يمكن للقاضي مراقبتها بالتالي أضحى القاضي ملزمًا بتحديد ميدان عمله وحدوده وذلك من خلال التأويل الصحيح لأحكام قانون التحكيم وفي هذا الإطار تتنزل هذه الدراسة كمحاولة لتحديد المجالات التي يمكن للقاضي أن يتدخل بها أثناء إجراءات العملية التحكيمية. ولعل خصوصية مادة التحكيم التي تقتضي ضرورة تطبيق القواعد القانونية الوطنية والأجنبية إضافة إلى المعاهدات الدولية تحتم على القاضي التمحص والتثبت من الأحكام خاصة وأن تطور مادة التحكيم بالأردن مرتبط بما سيوفره فقه القضاء من حلول ومواقف قد تدعم هذه المؤسسة القانونية.
