Abstract

This study discussed the impact of imprisonment on the imprisoned disbursements related to marriage and divorce, in the movement of the imprisoned right of capacity on others, capacity to get married, impact spouse's alimony, impact on forcing the imprisoned to divorce the spouse, impact of spouse's right to ask for separation, impact of incapability to spend on the spouse and the right to ask for separation. The study concluded to that: imprisonment does not affect the capacity of the imprisoned and that imprisonment of the close guardian does not drop his guardianship right on whom he guards if the access means is possible, otherwise it moves to the next of kin; also, the wife's alimony is not waived in case of spouse's imprisonment, in case of restraint not by her; also, forcing the spouse to divorce is not valid; the wife has the right to claim separation if the period of imprisonment exceeds one year or in case of insolvency to pay the alimony.

الملخص

تناولت هذه الدراسة مدى تأثير الحبس في تصرفات المحبوس المتعلقة ببعض مسائل الزواج والطلاق، كما في انتقال حق ولاية المحبوس على غيره، وفي ولايته في تزويج نفسه، وأثر الحبس على نفقة الزوجة سواء أكان المحبوس زوجاً أم زوجةً، وكذا أثره على إكراه المحبوس على تطليق زوجته، وأثر الحبس في حق الزوجة طلب التفريق من زوجها، وأثر إعسار المحبوس بالنفقة الزوجية في حق الزوجة طلب التفريق بينها وبين زوجها. وقد توصلت الدراسة لجملة من النتائج، فالحبس لا يؤثر على أهلية المحبوس، وحبس الولي الأقرب لا يسقط حقه في الولاية على من هي في ولايته إن وجدت إمكانية للوصول إليه، وإلا سقطت وانتقلت لمن يليه، كما أن نفقة الزوجة لا تسقط في حال حبس الزوج أو الزوجة في حال لم يكن المانع من جهتها، كما أن إكراه المحبوس على الطلاق لا يقع، ويحق للزوجة المطالبة بالتفريق بينها وبين زوجها إذا حبس لمدة تزيد على سنة أو في حالة إعساره بالنفقة عليها.
