تعد عقوبة الحبس قصير المدة من الموضوعات التي حظيت باهتمام كبير من جانب الفقهاء منذ فترة زمنية طويلة، لما لهذه العقوبة من مساوئ جمّة ما انفك الكثيرون منهم ينتقدونها، ويدعون إلى الحدّ منها أو استبعادها، وإحلال بدائل أخرى محلها، كما أولتها المؤتمرات الدولية والمحلية اهتمامها، ونادت بالحدِّ منها واقتراح بدائل لها، وقد تعددّت هذه البدائل إلا أنّ بديل الغرامة يتصدّرها نظراً لأهميتها المتزايدة في الوقت الحالي، وفاعليتها بوصفها عقوبة، بما يكفل تجنب مساوئ عقوبة الحبس قصير المدة، لذلك نلحظ اتجاه الكثير من التشريعات المعاصرة إلى اعتبار الغرامة بديلاً لهذه العقوبة، ولا بدّ للتشريع الأردني أن يسايرها في اتجاه تطوير بديل الغرامة، لاسيّما وأنه لم يأخذ بالبدائل الأخرى التي أخذ بها العديد من التشريعات الحديثة باستثناء بديل وقف تنفيذ العقوبة والذي هو بحاجة إلى تطوير أيضاً بما يتناغم مع أهداف السياسة الجنائية المعاصرة، وذلك بإحلال الغرامة محل عقوبة الحبس قصير المدة في التشريع الأردني الذي يعدّ هذه العقوبة أساسية للعديد من الجرائم دون أن يأخذ بعين الاعتبار ما لهذه العقوبة من مساوئ كثيرة يجب تلافيها تحقيقاً لمصلحة المجتمع.
