Abstract

Fasting is imposed by God on Muslims and other believers (Christians Jews) who preceded them due to its great benefits to people in their current and last or eternal life. Most valuable benefits of fasting are: self-control and purity, control of lust and protection from its drastic negative implications. Islam has legalized several means to meet or fulfill this noble goal. Sharia restricted and prohibited every sexual act that would spoil and null Muslim’s fasting. It strictly prohibited sexual intercourse during the day in Ramadan, and warned fasting people from approaching sex harassments and excitements…etc. The study investigates the sexual practices and their influence on safe or pure fasting. The researcher discusses the meaning; wisdom and virtue of fasting in part one. The second part is devoted to the impact of sexual behavior without having intercourse on essence of fasting. The third part examined the effect of sexual intercourse on the worship of fasting. The fourth part dealt with the provisions that should be followed if sexual intercourse occurred during fasting time. The researcher concluded his work with some findings and recommendations.

الملخص

فإن الصوم عبادة كتبها الله تعالى على المسلمين، كما كتبها على من سبقهم من أهل الكتاب؛ لما فيها من فوائد عظيمة، تعود بالنفع على الصائم في الدنيا والآخرة، ومن أجَلِ هذه الفوائد والمنافع تهذيب النفس وتزكيتها، وضبط الشهوة وعدم الوقوع في وحلها، وقد شرع الإسلام وسائل متعدّدة تؤدي إلى تحقيق هذا الهدف النبيل، فنهت الشريعة عن كل تصرّف جنسي من شأنه أن يفسد هذه العبادة ويبطلها، فحرّمت الجماع في نهار رمضان، وحذّرت من الاقتراب من مقدماته ودواعيه، وغير ذلك. وهذه الدراسة تبحث في هذه التصرّفات الجنسية وآثارها الشرعية في عبادة الصوم. وقد تناول الباحث في المبحث الأول معنى الصوم وحكمه وفضله، وتحدّث في المبحث الثاني عن أثر التصرّفات الجنسية دون الجماع في عبادة الصوم، أمّا المبحث الثالث فكان في أثر الجماع في عبادة الصوم، وتناول في المبحث الرابع أحكام كفارة الجماع في رمضان، وختم الباحث بحثه بخاتمة لخّص فيها النتائج والتوصيات.
