Abstract

In this paper, We address a topic of great significant which is the competency " in marriage in Islamic Jurisprudence (Fikih) because if its significance and alkafaa importance in modern days to sustain marriage between married couples, due to the devastating results of family breakdown and ending the marriage when breaching it which is against the aims of Islamic jurisdictions. According to Islamic Jurisdictions, the family is the basic block of the society. The society will weaken if the family weakens and vice versa because the society is a compilation of families.

الملخص

نتكلم في هذا البحث عن موضوعٍ غاية في الأهمية وهو الكفاءة في الزواج في الفقه الإسلامي وقانون الأحوال الشخصية الأردني، لما لأهميته في وقتنا الحاضر لاستمرار الحياة الزوجية بين الزوجين، ولما يترتب على الإخلال به من دمار هذه الأسرة وعدم ديمومتها، وهذا مغاير لأهداف الشريعة الإسلامية من الحفاظ على الأسرة لأنها اللبنة الأساسية في المجتمع، فإن ضعفت ضعف المجتمع بكامله وإن قويت قوي المجتمع لأن المجتمع ككل ما هو إلا مجموعة أسر.
