Abstract

The judgment issued by the constitutional court shall be final can't be challenged in any way. The constitutional court shall be entitled to absolute jurisdiction in the face of all powers and all of the original and the court's ruling shall apply directly unless it specifies another date for its validity. The problematic nature of the study is highlighted in several points the most important of which is: the lack of clarity of the position of the constitutional court on the nature of sentences and scope of the direction of the whole, as this problem arises in not specifying to what extent the effect of the sentence. So as to be limited only to the provider of payment or can benefit from others and to answer these problems have been asked many questions, the most important: is the absolute extension of the absolute ruling of the constitutional laws suit to respond to the appeal of the absence of interest or class? Dose the ruling in the constitutional case applies directly to the imam or revert to the past? The purpose of this study is to clarify the scope of authoritative judgment in the constitutional case and the time scale for their implementation from the point of view of the Jordanian legislator because of its impact on the stability of rights and legal centers. The importance of this study is highlighted by the lack of judicial rulings issued by the Jordanian constitutional court in this matter, and this was reflected in the statement of the position of the court form the scope of the courts judgments and extent to which the effects of the judgment can be extended. The descriptive and analytical methods were adopted in this study. Through the identification of the concepts involved in the study and analysis of the constitutional texts and legal and jurisprudence related to the subject matter of the study. The study concluded with a number of results, the most important of which is that the legislative texts which determine the absolute authenticity of the judgment rendered in the constitutional case have been absolute and general. It also concluded by highlighting certain recommendations in the most important of which is the need to clarify the final idea of the ruling issued by the constitutional court and to limit it only to the ruling on the unconstitutionality of the legislative text.

الملخص

تُعد الأحكام التي تصدرها المحكمة الدستورية، نهائية غير قابلة للطعن بأي وجه من أوجه الطعن، ويحوز حكم المحكمة الدستورية الحجية المطلقة في مواجهة جميع السلطات والكافة. والأصل أن يسري حكم المحكمة بأثر مباشر مالم تحدد تاريخاً آخر لسريانه. وتبرز إشكالية الدراسة في عدة نقاط أهمها: عدم وضوح موقف المحكمة الدستورية من طبيعة الحكم الصادر عنها ونطاقه اتجاه الكافة، كما تظهر هذه الإشكالية في عدم تحديد إلى أي مدى يمكن أن تمتد إليه آثار الحكم، بحيث تقتصر فقط على مقدم الدفع، أم يمكن أن يستفيد منها الآخرين. وللإجابة على هذه الإشكالية، تم طرح العديد من الأسئلة أهمها: هل تمتد الحجية المطلقة للحكم الصادر في الدعوى الدستورية برد الطعن لانتفاء المصلحة أو الصفة؟ وهل يسري الحكم الصادر في الدعوى الدستورية بأثر مباشر، أم يرتد أثره إلى الماضي؟ وتهدف هذه الدراسة إلى بيان نطاق حجية الأحكام الصادرة في الدعوى الدستورية والنطاق الزمني لتنفيذها من وجهة نظر المشرع الأردني لما له من أثر في استقرار الحقوق والمراكز القانونية. وتبرز أهمية هذه الدراسة؛ لقلة الأحكام القضائية الصادرة عن المحكمة الدستورية الأردنية المتعلقة في هذا الموضوع، وبالتالي انعكس ذلك سلباً على بيان موقف المحكمة من نطاق حجية الأحكام الصادرة عنها، والمدى الذي يمكن أن تمتد إليه آثار الحكم الصادر عنها. وقد تم اعتماد المنهجين الوصفي والتحليلي في هذه الدراسة، وذلك من خلال تحديد المفاهيم التي تنطوي عليها الدراسة، وتحليل النصوص الدستورية والقانونية والإجتهادات القضائية ذات الصلة بموضوع الدراسة. وقد خلصت هذه الدراسة إلى عدد من النتائج أهمها: أن النصوص التشريعية التي تقرر الحجية المطلقة للحكم الصادر في الدعوى الدستورية قد جاءت مطلقة وعامة. كما خلصت إلى إبراز توصيات معينه أهمها: ضرورة توضيح فكرة نهائية الحكم الصادر عن المحكمة الدستورية، واقتصارها فقط على الحكم الصادر بعدم دستورية النص التشريعي.
