Abstract

The commodification of the womb has become increasingly popular in the 21st century whereby; women who are unable to conceive due to a variety of reasons become look for women who are willing for a specified amount of money, to lease her womb be used to bear the pregnancy of the other people. The commodification of the womb has raised various ethical and legal questions. Some are related to the rights of both the surrogate mothers and the biological parents of the child. Others are related to the legitimacy of the child that results from this process. This paper will focus on the Jordanian legal approach to such contracts and what steps should be taken to regulate such the subject matter, with particular reference to the civil code and Islamic shari'a Religious Views. The paper will also highlight the issue on comparative study basis.

الملخص

في الآونة الأخيرة تعددت الحالات التي يلجأ فيها الأفراد الى استئجار رحم امرأة أجنبية رغبةً في أن تقوم هذه الأجنبية بعملية احتضان النطفة المخصبة والعائدة للزوجين مقابل مبلغ نقدي يدفع لها و في حالات استثنائية قد تقوم بهذا العمل بالمجان. تعمل هذه الاجنبية ومع نهاية فترة الحمل بتسليم المولود الى كل من الزوج والزوجة وعليه فإن مسألة استئجار الارحام تثير العديد من التساؤلات القانونية والاخلاقية كتلك المرتبطة بحقوق كل ذوي العلاقة والتزاماتهم. تتناول هذه الورقة عقود تأجير الأرحام بالتحليل المقارن مع تسليط الضوء على موقف المشرع الأردني منها وذلك من منظور القانون المدني من ناحية ورأي الفقه الاسلامي لمثل هذه العقود ، وهل من الممكن اعتبارها عقوداً قانونية واجبة التنفيذ ام انها تصطدم بعقبات تمنع تطبيقها على ارض الواقع.
