Abstract

Traffic safety is an important part of public order. It is linked to the main elements of public order: security, health, and public tranquility. It is considered the essence of administrative control. It was the duty of the administrative control authorities to exercise their powers to achieve traffic safety. The research aimed to know the administrative control of traffic safety and the means of exercising it, as well as knowing the limits of exercising judicial oversight over it. The researchers used the descriptive approach by reviewing the legislation regulating traffic control, and the analytical approach to analyze these texts. Based on the importance of this research, the extended problem emerged: What is the role played by administrative control authorities in achieving traffic safety in Palestine? the most important results is which that the Palestinian legislation deal with the issue of administrative control related to traffic safety are insufficient and not effectively implemented, there is no specific provision for administrative control related to traffic safety in general and specific legislation, and the practice of administrative control related to traffic safety is limited, and the weakness of the exercise of judicial oversight regarding administrative control. This research also recommended to work on issuing a law that supports the traffic law called the Traffic Safety Law, includes the provision for the establishment of an administrative control unit, and to activating the role of each of the Ministry Local government and municipalities in following up the infrastructure, and activating the administrative control authorities through issuing organizational and individual decisions that work to control vehicles and drivers, like withdrawal of licenses. Supporting the powers and duties of administrative control personnel to enhance traffic safety.

الملخص

: تشكل السلامة المرورية جزءاً هاماً من النظام العام، فهي ترتبط بعناصر النظام العام الرئيسية، الأمن والصحة والسكينة العامة، فهي تعتبر جوهر الضبط الإداري، وانطلاقاً من اتساع مجال المرور في المجتمع ومساسه بالحقوق والحريات الذي يعتبر الحق في سلامة الجسد أهمها، كان واجباً على سلطات الضبط الإداري أن تمارس صلاحياتها في تحقيق السلامة المرورية انطلاقا من دورها في حماية النظام العام. وقد هدف البحث الى معرفة طبيعة الضبط الإداري الخاص بالسلامة المرورية ووسائل ممارسته، كذلك معرفة حدود سلطة هذا الضبط في الظروف العادية والاستثنائية ومن ثم حدود ممارسة الرقابة القضائية عليه. لذلك استخدم الباحثون في هذا البحث المنهج الوصفي لدراسة التشريعات الناظمة لمسألة الضبط المروري، والمنهج التحليلي لتحليل تلك النصوص وربطها بالآراء الفقهية والنظرية بالاستعانة بمجموعة من المؤلفات القانونية المتخصصة للوصول الى النتائج والتوصيات. وانطلاقاً من فكرة وأهمية هذا البحث ظهرت الإشكالية المتمثلة في ما هو الدور الذي تمارسه سلطات الضبط الإداري في تحقيق السلامة المرورية في فلسطين؟. مجموعة من النتائج تم التوصل إليها في هذا البحث أهمها أن التشريعات والأنظمة الفلسطينية التي عالجت موضوع الضبط الإداري المرتبط بالسلامة المرورية غير كافية وغير مطبقة بشكل فعلي، وأنه لا يوجد تخصيص للضبط الإداري المتعلق بالسلامة المرورية في التشريعات، وعدم ممارسة الضبط الإداري الخاص بالسلامة المرورية إلا في حدود ضيقة، وضعف ممارسة الرقابة القضائية الخاصة بممارسات الضبط الإداري المروري. كما أوصى البحث العمل على إصدار قانون يساند قانون المرور يسمى قانون السلامة المرورية يتضمن النص على إنشاء وحدة الضبط الإداري، إضافة إلى تفعيل دور وزارة الحكم المحلي والبلديات في متابعة البنى التحتية وفق الأسس الهندسية العالمية، وتفعيل سلطات الضبط الإداري من خلال إصدار قرارات تنظيمية وفردية تعمل على ضبط المركبات والسائقين كنظام النقاط والحجز وسحب الرخص، ودعم اختصاصات وممارسة رجال الضبط الإداري لصلاحياتهم المستمدة من القوانين في تعزيز السلامة المرورية من خلال ممارسة الضبط الإداري.
