Objective: This study aims to clarify the civil liability of the Palestinian lawyer under the applicable legislation by analyzing the legal framework governing the legal profession and defining the limits of the duty of care owed to clients, with a focus on forms of professional fault and the possibility of holding the lawyer liable for compensation. Methodology: The study adopts a descriptive–analytical approach based on examining relevant legal and judicial texts, supported by comparative doctrinal opinions, thereby reflecting the relationship between theory and practice. Main Findings: The study revealed that the rules of civil liability are not effectively enforced in the field of legal practice, and that the existing judicial and disciplinary mechanisms suffer from shortcomings in holding lawyers accountable for their professional errors. Conclusions and Recommendations: The study concludes that weak enforcement of liability negatively affects clients’ rights, the stability of the profession, and public trust. It recommends launching a national professional dialogue that contributes to formulating a modern legislative vision that ensures stability and keeps pace with legal developments.

الهَدَف: تَهدِفُ الدِّراسَةُ إلى بَيانِ المَسؤوليَّةِ المَدَنيَّةِ لِلمُحامِي الفِلسطينِي في ضَوءِ التَّشريعاتِ النّافِذَةِ، مِن خِلالِ تَحلِيلِ الإطارِ القانُونِي لِمِهنَةِ المُحاماةِ وتَحدِيدِ حُدودِ العِنَايةِ الواجِبَةِ تُجاهَ المُوكِّلينَ، مَع التَّركِيزِ على صُوَرِ الخَطَأ المِهنِي وإمكانيَّةِ مُساءَلَةِ المُحامِي بِالتَّعويضِ. المَنهَج: اِعتَمَدَتِ الدِّراسَةُ المَنهَجَ الوَصفِي التَّحلِيلِي القائِمَ على تَحلِيلِ النُّصوصِ القانُونِيَّةِ وَالقَضائِيَّةِ ذاتِ الصِّلَةِ، مَدعومَةً بِالمَواقِفِ الفِقهِيَّةِ المُقارَنَةِ، بِما يُعكِسُ العَلاقَةَ بَينَ النَّظَرِيَّةِ وَالتَّطبِيقِ. أهَمُّ النَّتائِج: أظهَرَتِ الدِّراسَةُ أنَّ قَواعِدَ المَسؤوليَّةِ المَدَنيَّةِ لا تُفَعَّلُ بِفاعِلِيَّةٍ في مَجالِ المُحاماةِ، وَأنَّ الآلِيّاتِ القَضائِيَّةَ وَالتَّأدِيبِيَّةَ القائِمَةَ تُعانِي قُصورًا في مُحاسَبَةِ المُحامِي عَن أَخطائِهِ المِهنِيَّةِ. الاستِنتَاجاتُ وَالتَّوصِيات: خَلَصَتِ الدِّراسَةُ إلى أنَّ ضَعفَ تَفعِيلِ المَسؤوليَّةِ يُؤثِّرُ سَلبًا على حُقوقِ المُوكِّلينَ وَعلى استِقرارِ المِهنَةِ وَثِقَةِ المُجتَمَعِ بِها، وَأوصَت بِضَرورَةِ إِطلاقِ حِوارٍ وَطَنِيٍّ مِهنِيٍّ يُسهِمُ في صِياغَةِ رُؤيَةٍ تَشريعيَّةٍ حَديثَةٍ تَضمَنُ الاستِقرارَ وَتُواكِبُ التَّطَوُّراتِ القانُونِيَّةِ.
