Abstract

Objective: To define civil liability frameworks for AI-induced harms under Iraqi Civil Law in comparative perspective. Methodology: A doctrinal-analytical theoretical approach was applied to examine legal provisions, identify gaps, and compare international legislation. Findings: The study found the Iraqi legal system lacks clear regulation on AI-related damages and shows an inconsistent approach to civil liability types. Conclusions: An integrated legislative framework is urgently required to address civil liability arising from AI applications. Recommendations: Include “due diligence” as a general liability principle, establish an independent regulatory authority, and promote legal capacity-building and awareness.

الملخص

الهدف: تحديد أطر المسؤولية المدنية عن اضرار الذكاء الاصطناعي في القانون المدني العراقي مقارنة بالتشريعات المقارنة. المنهج: استخدم البحث المنهج التحليلي والنظري لعرض القواعد القانونية، واستبيان الثغرات والمحددات في النصوص والتشريعات المقارنة. النتائج: تبين غياب تنظيمي واضح في القانون العراقي ينظم اضرار الذكاء الاصطناعي، وتعدد اشكال المسؤولية المدنية دون مواءمة بينها. الاستنتاجات: هناك حاجة ماسة لتطوير أطار تشريعي متكامل يعالج المسؤولية المدنية الناجمة عن تطبيقات الذكاء الاصطناعي. التوصيات: اقتراح ادراج معيار العناية الواجبة كشرط عام للمسؤولية، وتأسيس هيكل رقابي مستقل، وتفعيل البنية القانونية عبر التدريب والتوعية.
