Abstract
Purpose: This study aims to examine the evidentiary value of the testimony of a mute person in Islamic jurisprudence in comparison with the Palestinian Evidence Law. Methodology: To achieve this objective, the researcher adopted a descriptive-comparative approach. Results: The study reached several findings, the most significant of which are the disagreement among Muslim jurists concerning the admissibility of the testimony of a mute person. The core of this disagreement lies in whether the verbal utterance of testimony constitutes a condition for the validity of testimony and whether ambiguity or doubt may arise in the manner such testimony is conveyed. Furthermore, the Palestinian Law of Evidence, in regulating witness competency, limits the categories of persons who are disqualified from giving testimony to those who are incapable of proper perception due to a mental disability and those who have not reached the age of fifteen. The law does not include mute persons among those disqualified from testifying. This omission indicates that a mute person is legally competent to testify. Accordingly, a mute witness may express his or her testimony through writing or comprehensible signs. Conclusions: The adoption of sign language to express the will of a deaf person is consistent with the prevailing opinion regarding considering the testimony of a deaf person in evidence. Recommendations: The study recommends the need to expand the learning and adoption of sign language by judicial employees, in line with considering the authenticity of a deaf testimony in evidence, and to expand the study of the issue in the legal and Sharia aspect, while studying the issue from the objective perspective and jurisprudence of outcomes.
