In this paper, we have clarified that one of the issues raised by Capital is the issue of copyright and keeping Trade Secrets. We have explained that the Jordanian legislator did not mention the importance of Trade Secrets while addressing the issue of meeting international conventions. However, we need an independent legislation to organize the issues of Copyright, Data, Electronic Money and Electronic Sites. All the above-mentioned should be under the umbrella of the Electronic Trade issue. Moreover, we have explained that short-hand solutions cannot cope up with the rapid spread of commercial activities. We have discussed both the linguistic and the legal meanings of Trade Secrets and showed that the historical development of Trade Secrets in Jordanian Laws was not enough to protect them. Furthermore, we have argued that this era is the era of information technology; therefore, there is a need to study relevant laws in a comprehensive fashion not only to meet international conventions but also to cope with recent developments.

لقد بينا في هذا البحث أنه من تحولات رأس المال مسائل الملكية الفكرية والمحافظة على السر التجاري.وبينا أن المشرع الأردني لم يأت على بيان أهمية السر التجاري وبيان أن المطلوب فقط هو إنفاذ المعاهدات الدولية بل نحن بحاجة إلى تشريع مستقل ينظم مسائل الملكية الفكرية ومسائل البيانات ومسائل النقد الإلكتروني، وتنظيم المواقع الالكترونية، كل ذلك بمناسبة أعمال التجارة الالكترونية، وبينَّا أن تسارع الأعمال التجارية لا تتحمل الحلول المختصرة، وعالجنا في البحث معنى السر التجاري لغوياً وقانونياً، وأن التطور التاريخي للأسرار التجارية في القانون الأردني لم يكن كافياً لحماية السر التجاري، وبينَّا أن هذا العصر من أهم سماته أن تقنية المعلومات تتمتع بالقدرة الهائلة على التوائم مع متطلباتها بذات القدر من التنبيه لأهمية الدراسة الشاملة لقواعد القانون بحيث لا تكون التدابير التشريعية مجرد إنفاذ التزامات دولية وبينها أنه لا بد للمشرع أن يوائم بين القواعد الجديدة وما استقر من قواعد في مختلف فروع القانون الأخرى.
