The Patentability of AI-Generated Inventions: A Comparative Study

Abstract

Purpose: This study aims to examine the extent to which artificial intelligence (AI)-generated inventions are eligible for patent protection under Palestinian legislation in comparison with selected comparative legal systems. Methodology: The study adopts a descriptive, analytical, and comparative approach through the analysis of relevant legal texts and the examination of international legal and practical experiences related to AI-generated inventions. Results: The findings reveal that patents cannot currently be granted directly to AI-generated inventions, primarily because existing legal systems require the inventor to be a natural person. The study also identifies a legislative gap in regulating AI-generated inventions and highlights an international trend toward attributing inventorship to the human contributor involved in the inventive process. Conclusion: The study concludes that there is an urgent need to develop existing legal frameworks to address the challenges posed by artificial intelligence technologies to patent systems and to ensure adequate protection for innovation in the digital era. Recommendations: The study recommends amending relevant Palestinian legislation, establishing a clear legal definition of the inventor in the context of AI-generated inventions, adopting an approach that assigns patent rights to the human contributor, and developing specialized mechanisms for examining patent applications involving artificial intelligence technologies.

الملخص

الهدف: تهدف هذه الدراسة الى تحديد مدى قابلية مخرجات الذكاء الاصطناعي للحماية ببراءات الاختراع في ظل التشريعات الفلسطينية مقارنة بالتشريعات المقارنة. المنهجية اعتمدت الدراسة على المنهج التحليلي والمقارن، من خلال دراسة النصوص القانونية ذات الصلة وتحليل التجارب الدولية في هذا المجال، إلى جانب تقييم الوضع القانوني الفلسطيني المتعلق باستخدام الذكاء الاصطناعي في الاختراعات. النتائج: أظهرت الدراسة عدم إمكانية منح براءات اختراع مباشرة لمخرجات الذكاء الاصطناعي، ووجود قصور تشريعي في تنظيم هذه المسألة، مع اتجاه دولي لإسناد صفة المخترع إلى الانسان. الاستنتاجات: خلصت الدراسة إلى أن هناك حاجة ملحة الى تطوير الإطار القانوني القائم لمواكبة التحديات التي تفرضها تقنيات الذكاء الاصطناعي على نظام براءات الاختراع. التوصيات: توصي الدراسة بضرورة تعديل القوانين الفلسطينية ذات الصلة، ووضع تعريف قانوني واضح للمخترع، واعتماد مقاربة تُسند الحقوق للإنسان، واستحداث آليات خاصة لفحص براءات الاختراع المرتبطة بالذكاء الاصطناعي.
