Abstract
Purpose: This study aimed to examine the adequacy of the existing Palestinian legislation in regulating the circulation of virtual currencies by analyzing the experiences of selected comparative jurisdictions that have either prohibited, permitted, or regulated their use. Methodology: The study adopted the descriptive-analytical approach. It began by explaining the concept, types, advantages, and risks of virtual currencies. It also examined the positions of comparative legal systems toward virtual currencies and analyzed their legislative frameworks, whether they permit, regulate, or prohibit their circulation and use. Furthermore, the study explored the applicability of anti-money laundering and counter-terrorist financing legislation to transactions involving virtual currencies. Results: The study found that the Palestinian legal system remains in a stage of temporary prohibition of virtual currencies due to the absence of a specific legislative framework governing them. It also revealed that the Palestinian legislator's decision to prohibit the circulation and use of virtual currencies until they are regulated by the Palestine Monetary Authority aims to mitigate the legal and economic risks associated with them. Moreover, Decree-Law No. (39) of 2022 on Anti-Money Laundering and Counter-Terrorism Financing provides a legal basis for subjecting crimes committed through virtual currencies to its provisions. Conclusions: The study concluded that a temporary prohibition cannot serve as a substitute for a comprehensive legislative framework governing virtual currencies. Although the current Palestinian legal framework provides partial protection through the application of anti-money laundering and counter-terrorism financing legislation, it remains insufficient to address the legal and financial challenges posed by technological developments in this field. Recommendations: The study recommends introducing a definition of virtual assets or virtual currencies into the Palestinian Anti-Corruption Law No. (1) of 2005 and its amendments to ensure that offenses committed through the use of such currencies fall within its scope. It further recommends enacting a dedicated Palestinian legal framework regulating the issuance, circulation, and supervision of virtual currencies.

الملخص
الهدف: هدفت هذه الدراسة إلى فحص مدى صلاحية التشريعات النافذة في فلسطين لتنظيم تداول العملات الافتراضية، وذلك من خلال تحليل تجارب الدول المقارنة في حظر هذه العملات أو إباحتها أو تنظيمها. المنهجية: تم تبني المنهج الوصفي التحليلي، حيث بدأت الدراسة بشرح مفهوم العملات الافتراضية وأنواعها ومزاياها ومخاطرها. كما تم بيان موقف الأنظمة القانونية المقارنة منها وتحليل نصوص تشريعاتها، سواء أباحت تداولها أو استعمالها أو حظرته، مع التطرق إلى مدى انطباق هذا النوع من العملات على التشريعات المتعلقة بمكافحة جرائم غسل الأموال وتمويل الإرهاب. النتائج: توصلت الدراسة إلى أن النظام القانوني الفلسطيني ما زال في مرحلة الحظر المؤقت للعملات الافتراضية، لعدم وجود تشريع خاص ينظمها. كما تبين أن توجه المشرع الفلسطيني بحظر تداولها واستعمالها إلى حين تنظيمها من قبل سلطة النقد يهدف إلى الحد من المخاطر القانونية والاقتصادية المرتبطة بها، وأن القرار بقانون رقم (39) لسنة 2022 بشأن مكافحة غسل الأموال وتمويل الإرهاب يوفر أساسًا قانونيًا لإخضاع الجرائم المرتكبة باستخدام العملات الافتراضية لأحكامه. الاستنتاجات: خلصت الدراسة إلى أن الحظر المؤقت لا يشكل بديلاً عن وجود إطار تشريعي متكامل ينظم العملات الافتراضية، وأن التشريعات الفلسطينية الحالية توفر حماية جزئية من خلال تطبيق أحكام مكافحة غسل الأموال وتمويل الإرهاب، إلا أنها لا تزال بحاجة إلى تنظيم قانوني خاص يواكب التطورات التقنية والمالية في هذا المجال. التوصيات: توصي الدراسة بضرورة إدخال تعريف للأصول أو العملات الافتراضية في قانون مكافحة الفساد رقم (1) لسنة 2005 وتعديلاته، بما يضمن انطباق الجرائم الواردة فيه على من يستعمل هذه العملات في ارتكابها، إلى جانب وضع إطار تشريعي فلسطيني خاص ينظم إصدارها وتداولها والرقابة عليها.
