The Legal Frameworks of Virtual Assets in Palestinian Legislation

Abstract

Objective: This study analyzes the legal framework governing virtual assets in Palestinian legislation and assesses whether the existing rules adequately address their legal characterization, supervision, and procedural treatment. Methodology: It applies analytical and descriptive methods to relevant Palestinian legislation and judicial applications, with limited comparison to Financial Action Task Force standards. Key Findings: Decree-Law No. 41 of 2022 moved the Palestinian system from legislative silence to a temporary, partially organized prohibition by banning virtual-asset trading and related services pending regulation by the Palestine Monetary Authority. Nevertheless, the framework does not comprehensively determine the legal nature of virtual assets, licensing requirements, customer protection, risk-based supervision, digital-evidence procedures, or mechanisms for seizure, freezing, and confiscation. Judicial applications generally treat unlicensed trading as an independent offense, while revealing uneven technical capacity to establish ownership, trace transactions, and control the asset itself. Conclusions: The current prohibition provides an initial protective measure but is insufficient as a complete regulatory policy. Recommendations: Palestinian legislation should adopt an integrated licensing, anti-money-laundering, evidentiary, and asset-recovery framework supported by specialized institutions and international cooperation.

الملخص

الهدف: تحلل هذه الدراسة الإطار القانوني الناظم للأصول الافتراضية في التشريع الفلسطيني، وتقوّم مدى كفايته في تحديد طبيعتها القانونية وتنظيم الرقابة عليها ومعالجتها إجرائيًا. المنهج: اعتمدت الدراسة المنهجين التحليلي والوصفي في فحص التشريعات الفلسطينية والتطبيقات القضائية ذات الصلة، مع إفادة مقارنة محدودة من معايير مجموعة العمل المالي. أهم النتائج: نقل القرار بقانون رقم (41) لسنة 2022 النظام الفلسطيني من الصمت التشريعي إلى حظر مؤقت منظم جزئيًا، إذ منع التداول بالأصول الافتراضية وتقديم خدماتها إلى حين تنظيمها من سلطة النقد الفلسطينية. غير أن الإطار القائم لا يحسم الطبيعة القانونية لهذه الأصول، ولا يضع نظامًا متكاملًا للترخيص وحماية المتعاملين والرقابة القائمة على المخاطر، كما يفتقر إلى قواعد تفصيلية للدليل الرقمي وضبط الأصول وتجميدها ومصادرتها. وتظهر التطبيقات القضائية أن التداول غير المرخص يعامل غالبًا كجريمة مستقلة، مع تفاوت القدرة الفنية على إثبات الملكية وتتبع التحويلات والسيطرة على الأصل ذاته. الاستنتاجات: يمثل الحظر القائم تدبيرًا وقائيًا أوليًا، لكنه لا يشكل سياسة تنظيمية مكتملة. التوصيات: ينبغي تبني إطار تشريعي متكامل للترخيص ومكافحة غسل الأموال والإثبات واسترداد الأصول، تدعمه وحدات متخصصة وتعاون دولي فعال.
