Litigation Deadlines Before the Administrative Court in Palestine

Abstract

Objective: This study aims to comment on Article (23) of Decree-Law No. (41) concerning the administrative courts in Palestine, which addresses the time limits for litigation before the Palestinian administrative judiciary. The legislator has adopted a comprehensive perspective on time limits and the situations that may arise for litigants during their exercise of the right to access the judiciary, especially after the issuance of the decree-law under discussion. These time limits were previously included in Chapter Fourteen of the Civil and Commercial Procedures Law No. 2 of 2001.Methodology: This research uses a comparative analytical method by analyzing and studying the litigation time limits before the administrative court in Palestine, comparing them in some respects with other legislations, such as those of Egypt, Jordan, and Tunisia.Key findings : The study concluded that the Palestinian legislator did not allow the administrative judge to exercise a positive role in assisting the weaker party in the administrative litigation process, namely the plaintiff against the administration, by adopting a certain flexibility in litigation time limits. This approach has become an obstacle that affects the right to litigate, especially since it overlooked some cases that require distinguishing between the interruption and the suspension of litigation time limits. Conclusions: It appears that litigation time limits in the Palestinian administrative judiciary are characterized by rigidity and ambiguity, along with the absence of a judicial role in introducing flexibility, which has weakened the right to litigate and created confusion in judicial practice. In contrast, the Tunisian system demonstrates the possibility of adopting a more flexible approach that balances administrative stability with the guarantees of a fair trial. Recommendations: The study recommends the urgent need to reconsider legislative policies related to litigation time limits by allowing some flexibility for the administrative judge in assisting the plaintiff against the administration. Additionally, it emphasizes the necessity of distinguishing between cases that definitively cut off the time limits for filing lawsuits and those that temporarily suspend them.

الملخص

الهدف: تهدف هذه الدراسة إلى التعليق على المادة (23) من القرار بقانون عدد (41) بشأن المحاكم الإدارية في فلسطين، التي تتناول آجال التقاضي أمام القضاء الإداري الفلسطيني، أين تبنى المشرع رؤية شاملة لتناول الآجال والحالات التي قد تطرأ على المتقاضي أثناء ممارسة حقه في الولوج إلى القضاء خاصة بعد إصدار القرار بقانون موضوع التعليق، إذ أن تلك الآجال كانت قد وردت سابقا صلب الباب الرابع عشر من قانون أصول المحاكمات المدنية والتجارية رقم 2 لسنة 2001 (دولة فلسطين، 2022). المنهج: تم خلال هذا البحث استخدام منهج تحليلي مقارن من خلال تحليل ودراسة آجال التقاضي أمام المحكمة الإدارية في فلسطين أين تمت مقارنتها في بعض المواضع مع التشريعات الأخرى على غرار التشريع المصري، والأردني، والتونسي. النّتائج: انتهت الدراسة الى ان المشرع الفلسطيني لم يسمح للقاضي الإداري من إعمال دوره الإيجابي في مساعدة الطرف الأضعف في عملية التقاضي الإداري، وهو مُقاضي الإدارة عن طريق التعامل بنوع من المرونة في آجال التقاضي، هذا التمشي أضحى يسبب أحد العراقيل التي تمس من حق التقاضي سيما أنه تغافل عن بعض الحالات التي وجب التمييز فيها بين قطع آجال التقاضي، ووقفها. الاستنتاجات: يتبيّن أن آجال التقاضي في القضاء الإداري الفلسطيني تتسم بالصرامة والغموض، مع غياب دور القاضي في تليينها، مما أضعف ضمان الحق في التقاضي وأربك التطبيق القضائي، في حين تُظهر المقارنة مع التشريع التونسي إمكانية اعتماد نهج أكثر مرونة يحقق التوازن بين استقرار الإدارة والمحاكمة العادلة. التوصيات: توصي الدراسة على الحاجة الملحّة لإعادة النّظر في السياسات التشريعية المتعلقة بآجال التقاضي من خلال السماح ببعض المرونة للقاضي الإداري في مساعدة مُقاضي الإدارة، إضافة إلى ضرورة التمييز بين الحالات القاطعة لآجال رفع الدعوى والحالات التي توقفها.
