Purpose: This study explores the extent to which the rules of tort liability under the Jordanian Civil Code—specifically Article 256—can be applied to damages resulting from climate change. It highlights the legal challenges involved in proving causation and identifying the liable party, particularly in light of the complex and diffuse nature of environmental harm. Methodology: The research adopts a comparative analytical methodology, drawing on a comparison between Jordanian legislation and other legal systems, including French and German law. It also analyzes relevant international judicial decisions in climate litigation. Findings: The study finds that the current legal framework in Jordan lacks explicit provisions addressing liability for emerging environmental damage. Recommendations: It recommends legislative reform to provide effective legal protection for affected individuals. Furthermore, it emphasizes the need for Jordanian courts to adopt a broad and flexible interpretation of tort principles to overcome evidentiary barriers and promote environmental legal awareness.

الهدف: هدفت هذه الدراسة إلى بيان مدى قابلية قواعد المسؤولية التقصيرية في القانون المدني الأردني لتطبيقها على الأضرار الناجمة عن التغيرات المناخية، مع التركيز على المادة (256) من القانون المدني. تتناول الدراسة التحديات المتعلقة بإثبات العلاقة السببية وتحديد الفاعل الضار في ظل تعقيد الأضرار البيئية. المنهجية /المنهج تم اعتماد منهج تحليلي مقارن، من خلال مقارنة القانون الأردني بنظيره الفرنسي والألماني، وتحليل اجتهادات قضائية دولية في قضايا المناخ. النتائج وتخلص الدراسة إلى أن الإطار التشريعي الحالي يفتقر إلى نصوص واضحة تُعالج المسؤولية عن الأضرار البيئية، التوصيات: مما يتطلب إدخال تعديلات قانونية تعزز الحماية للمتضررين. ومن أبرز التوصيات: ضرورة تفسير موسّع ومرن لقواعد المسؤولية التقصيرية من قبل القضاء الأردني لتجاوز قيود الإثبات، وتعزيز الوعي البيئي القانوني.
